NYS Food Donation and Food Scraps Recycling Law Is Expanding

Join DEC for a webinar on January 28, 2026 from 1:00 – 2:00 PM to hear updates on the implementation of the NYS Food Donation and Food Scraps Recycling law and learn about the expansion of the law set for 2027 and 2029. 

  • Effective January 1, 2022, entities that generate an annual average of two tons of wasted food per week or more must donate excess edible food and recycle all remaining food scraps if they are within 25 miles of an organics recycler (such as a composting facility, anaerobic digester, etc.). 
  • Effective January 1, 2027, entities that generate an annual average of 1 ton of wasted food per week or more must donate excess edible food and recycle all remaining food scraps if they are within 50 miles of an organic recycler.  
  • Effective January 1, 2029, entities that generate an annual average of 0.5 ton of wasted food per week or more must donate excess edible food and recycle all remaining food scraps if they are within 50 miles of an organic recycler. 

Utilize the Food Waste Estimator tool developed by NYS Pollution Prevention Institute to estimate the weight of wasted food generated each week. 

DEC is required to provide a list of entities required to comply with the law. View the list of designated food scraps generators for 2026.
